Which products are excluded from the right of return?

Article 10.1 Exclusion of the Right of Withdrawal for Specific Products

The consumer acknowledges and agrees that the right of withdrawal is excluded for the following products:

a. Glue traps for pest control;
b. Fluorescent tubes intended for use in fly zappers;
c. Biocides intended for pest control;
d. Bait intended for pest control.

The exclusion of the right of withdrawal for the above-mentioned products is based on the following grounds:
a. These products are of a personal or hygienic nature and are not suitable for return for reasons of health protection or hygiene if the seal has been broken after delivery;
b. These products may lose or significantly reduce their effectiveness after opening and/or use, making them unsuitable for return;
c. In the case of biocides and baits, return may pose risks to health and safety.

If an agreement relates to both products for which the right of withdrawal is not excluded and products for which the right of withdrawal does apply, the right of withdrawal remains in full force for the latter category.
